Auction Conditions
The auction house VIA GmbH carries out the auction on behalf of and for the account of the owners in compliance with the provisions of the Austrian Trade Code. By submitting a bid, in writing or verbally (by telephone), the auction conditions are accepted. Participation in the auctions requires that the participant has read and accepted the auction conditions.

The description in the catalog and the preservation classifications were carried out with the utmost conscientiousness. The grade information was given strictly in accordance with the grades common in the European coin trade and is considered a personal assessment. The images of the pieces are part of the description; in case of doubt, the text has priority. Any description errors do not constitute liability for legal or material defects.
The starting prices in euros (€) stated in the catalog are minimum prices that must not be fallen below. Interested buyers can submit bids in writing or by telephone. Bids can be submitted up to 4 hours before the start of the auction on the day of the auction. OR bids and limitations are excluded in e-live auctions. Any errors when submitting a bid are the responsibility of the bidder. Telephone bids require written confirmation (email). Unknown bidders will be asked for securities and references. New customers must register for the auction at least 2 working days before the auction date so that a reference check is possible in time. If references cannot be obtained, a deposit of 25% of the bid amount or the details of a valid credit card (VISA, MASTERCARD) must be deposited. The amount will then be offset against the purchase and any excess will be returned.
The lot numbers requested by the customer and a telephone number that is valid at that time must be announced at least 24 hours before the start of the auction and the desired lot numbers must be offered at least at the starting price. Live telephone bidding is only possible for lots over €300. If no telephone connection is established in time, the auction house cannot be held responsible for this.
Participation in an e-live auction is free of charge. We assume no liability for the transmission of bids, nor any downtime or delay times caused by maintenance and restoration of the respective server due to disruption or problems in internet traffic.
Every customer must take a bidder number and register before entering the auction room. The bidder buys as is; can settle and pay at any time and take the coins with you. For cash amounts over €2,000, the customer must identify themselves with a valid identity document.
Usually 5-10% (see table). In purely electronic auctions, bidders must adhere to the specified increase levels. If this is not the case, the bid is automatically adjusted to the next higher increase level.
The bid is accepted after the highest bid has been called three times and requires acceptance and payment. The hammer price is one step higher than the penultimate bid. Unless the auctioneer specifies otherwise, the lots will be sold in the catalog number sequence. The auctioneer also has the right not to accept bids, to withdraw or combine lots. In the event of misunderstandings during the auction, the auctioneer is entitled to reopen the auction. In the event of an error in the catalog, the auctioneer will announce the correction and sell the lot in accordance with this change, whereby written bids cannot be taken into account unless the written bidder has informed us that he has noticed the error when submitting the bid. In the hall it is possible to only offer half the increase level. (Cut Bid). However, this can only be done once per lot. All sales in the room are irrevocable.
The hammer price is a net price within the meaning of the sales tax law and forms the basis for calculating the premium to be paid by the buyer. The buyer pays 23% of the hammer price. This sum includes the statutory sales tax.
All tickets marked with an asterisk (*) after the ticket number are considered VAT-exempt gold coins. The customer only pays the surcharge of 20% and the shipping costs on top of the hammer price.
Unless otherwise agreed, payment of the auction invoice is due immediately for buyers present and no later than 14 days after receipt for written bidders. In case of late payment, interest of 1% per month will be charged. The right of ownership only passes to the buyer after full payment for the goods. We reserve the right to retain the auction goods and only deliver them after full payment. Legal fees, court costs and other costs incurred in connection with debt collection are borne by the buyer. When paying by credit card or Paypal, the expenses charged by the credit institution amounting to 4.5% of the invoice amount will be passed on to the customer. NEW: When paying with cryptocurrency, 2% of the total (surcharge) will be charged (the following cryptocurrencies are accepted: Bitcoin, Ethereum, BNB, Busd). In the case of advance payments that are not paid despite a reminder, the buyer loses his rights from the knockdown and the auction goods can be auctioned at his own expense. In this case, the buyer is liable for the loss of the amount due to us, which can also be sued in court. However, the buyer has no claim to the additional proceeds.
Shipping is at the buyer’s expense and risk. The minimum charge for postage and insurance is: Domestic € 10, Europe € 15 and non-European countries € 25. For goods with a value of €1,000 or more, the customer will be charged 1.2% as a flat rate for insured shipping for transport insurance. If shipping via Fedex, shipping costs must be requested separately. Foreign customers purchase according to their country's foreign exchange, customs and tax regulations. Shipping formalities will be taken care of by the auctioneer. Shipping instructions must either be noted on the bid slip or given in writing immediately after the auction. If the shipment arrives damaged or the customer does not receive a shipment or notification letter within a month, the customer must notify us immediately so that we can notify the insurance company and initiate an investigation. If the customer is notified too late, they are not entitled to compensation.
All coins are unconditionally guaranteed to be genuine and as described. All present bidders generally purchase “as is”; You cannot make any complaints regarding quality and description after the bid has been accepted. Excluded are traces of handles, frames or repairs that were mistakenly overlooked. If you take delivery of the goods in person, any complaints regarding quality and incorrect description must be made on the day of takeover. Justified complaints will of course be accepted, but the items complained about must be in the condition we delivered. Coins and medals in “fine” condition or of poor quality are excluded from the quality guarantee, as are lots that generally cannot be claimed (the number of pieces stated - unless grossly different - is only to be understood as an approximate figure). Excluded from the complaint period is the authenticity of the pieces, which we always guarantee up to the purchase price. In the event of disagreements, the auctioneer may call in experts of his or her choice; the losing party bears the costs.
Coins that are encapsulated and encapsulated by a grading company such as PGCS, NGC, etc. cannot be claimed if they are found to be in a different grade. The complaint deadline of 7 days must be strictly adhered to. For customers who purchase in advance, complaints can only be accepted up to 21 days after the auction. Complaints are generally handled by us for the account of the consignor. We reserve the right to inform bidders, if claims exist, to assert them directly against the consignor. This is always used when the consignor has already been settled.
The place of jurisdiction for all proceedings is Vienna. However, we also reserve the right to sue the debtor at his place of residence. Only the German text of the auction conditions is legally valid.
